By accessing or using MoPix ("the Service"), operated by Casari Enterprises LLC ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, do not use the Service. Use of the Service constitutes your acceptance of any updates to these Terms.

MoPix is a marketplace platform connecting below-the-line (BTL) film and television crew members with production companies and producers seeking talent. The Service includes profile creation, AI-powered crew matching using our proprietary Intent Refinement technology (patent pending, USPTO filing April 30, 2026), job discovery, and communication tools. The Service currently operates in the United States and Canada.

You retain ownership of all content you submit to the Service, including profiles, credits, portfolio materials, and communications. By posting content, you grant MoPix a worldwide, non-exclusive, royalty-free license to display, distribute, and use your content solely in connection with operating and improving the Service. You represent and warrant that you have the right to share any content you post and that it does not violate any third-party rights.

MoPix uses artificial intelligence to provide crew matching, recommendations, and job discovery. Our proprietary Intent Refinement system engages in conversational clarification to improve the accuracy of search results. AI-generated suggestions are informational only and should not be relied upon as professional, legal, or employment advice. Results may not always be accurate or complete. MoPix reserves the right to modify, improve, or discontinue AI features at any time.

All hiring decisions — including qualification verification, background checks, skills assessment, reference checking, union status verification, and all other due diligence — are the sole responsibility of the hiring party (production company, producer, or individual). MoPix makes no representations or warranties regarding any crew member's qualifications, experience, reliability, or suitability for any role. Users expressly agree to independently verify all credentials before engagement or hire. MoPix is not a staffing agency, employment agency, or party to any employment relationship formed through the platform. MoPix is not liable for any disputes, damages, losses, or claims arising from hiring decisions, engagements, or relationships formed through the Service.

The MoPix platform, including its design, software, and technology, is protected by copyright, trademark, and patent law. Patent Pending: MoPix has filed a utility patent application with the USPTO (filing date: April 30, 2026) covering our workforce disambiguation and conversational matching technology. You may not copy, modify, distribute, reverse-engineer, or create derivative works from any part of the platform without our prior written authorization. "MoPix" and associated marks are trademarks of Casari Enterprises LLC.

Your use of the Service is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our collection and use of personal data as described in the Privacy Policy.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. MOPIX DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED. AI-GENERATED RESULTS ARE NOT GUARANTEED TO BE ACCURATE, COMPLETE, OR SUITABLE FOR ANY PARTICULAR PURPOSE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CASARI ENTERPRISES LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE. OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO MOPIX IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100 USD.

You agree to defend, indemnify, and hold harmless Casari Enterprises LLC, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your User Content; or (d) any hiring decisions or engagements made through the platform.

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any dispute arising from or relating to these Terms or the Service shall first be subject to good-faith negotiation. If not resolved within 30 days, disputes shall be submitted to binding arbitration in Los Angeles County, California, under the rules of the American Arbitration Association (AAA). You waive any right to participate in a class action lawsuit or class-wide arbitration. Nothing in this section prevents either party from seeking injunctive or equitable relief in a court of competent jurisdiction.

MoPix reserves the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or any conduct we determine is harmful to the platform or its users. You may terminate your account at any time by contacting support@mopix.io. Termination does not affect any rights or obligations that arose prior to termination. Sections 7, 9, 11, 12, 13, and 14 survive termination.

We may update these Terms from time to time. We will provide at least 30 days' notice of material changes via email or prominent notice on the platform. Continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service and may request account deletion.
